CJN warns judges not to prioritize public opinion above constitution of Nigeria

The Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, has said that public opinion, no matter how serious or weighty it might be, cannot override or supersede the constitution of the country.

The CJN said this while inaugurating another batch of 23 judges for the Federal High Court of Nigeria at the Supreme Court in Abuja on Wednesday, October 4.

According to him, the court is always guided by the law, particularly the constitution, in its adjudication of cases.

He therefore charged judges in the country to always apply constitutional provisions when deciding each case that may be assigned to them.

“Several vitriolic attacks are regularly heaped on the judiciary; however, it is crystal clear that public opinion, no matter how serious or weighty it might be, cannot override or supersede the constitution of the country, which we apply when deciding each case,” he said.

Justice Ariwoola emphasized the importance of upholding the constitution and the rule of law in the face of public pressure. He highlighted that judges have a duty to remain impartial and make decisions based on the provisions of the constitution, regardless of public sentiment.

He acknowledged the constant criticism faced by the judiciary and urged judges to remain steadfast in their commitment to justice. He stated that while public opinion may carry weight, it cannot override the constitution, which serves as the bedrock of the nation’s legal system.

The CJN’s stance sends a clear message to judges that their role is to interpret and apply the law, and not to be influenced by external influences, be it public opinion or political pressure. This reaffirmation of the judiciary’s independence and commitment to the constitution is essential for the effective functioning of the legal system.

Furthermore, Justice Ariwoola’s remarks serve as a reminder to the public about the importance of respecting the rule of law. While individuals may disagree with certain decisions, it is crucial to remember that the constitution provides the framework for justice and legal proceedings.
